GENERAL TERMS AND CONDITIONS § 1. Non-Disclosure and Prohibition of Disclosure All information provided by the real estate agent, including property details and exposés, is intended exclusively for the client. The client is expressly prohibited from disclosing any property information or documents to third parties without the prior written consent of the agent. If the client breaches this obligation and a third party, or any other person who has received the information directly or indirectly, concludes the principal contract, the client shall be obliged to pay the agreed commission plus applicable VAT. § 2. Dual Agency The agent is entitled to act on a commission basis for both the seller and the buyer. § 3. Information Provided by the Owner The agent points out that all property information provided originates from the seller or from a third party commissioned by the seller. The agent has not independently verified the accuracy of this information. It is the client's responsibility to verify the information provided. The agent assumes no liability for its accuracy. § 4. Limitation of Liability The liability of the agent shall be limited to cases of gross negligence or intentional misconduct, unless the client suffers bodily injury or loss of life as a result of the agent’s actions. § 5. Anti-Money Laundering Compliance In accordance with the German Money Laundering Act (GWG), we are required to identify and retain information regarding the contracting parties, their representatives, and beneficial owners when initiating a specific purchase transaction. Our contractual partners are obliged under Section 11 GWG to cooperate in fulfilling these legal requirements. § 6. Limitation Period The limitation period for all claims for damages by the client against the agent shall be three (3) years. It begins on the date the event giving rise to the claim occurred. If statutory limitation periods provide for a shorter limitation period in individual cases, such statutory provisions shall prevail. § 7. Place of Jurisdiction If both the agent and the client are merchants within the meaning of the German Commercial Code (HGB), the registered office of the agent shall be agreed as the place of performance and jurisdiction for all obligations and claims arising from the contractual relationship. § 8. Consumer Arbitration Board The competent consumer arbitration body is: Universal Arbitration Board of the Federal Government – Centre for Arbitration e.V.
